Lawmakers in Wyoming just introduced a bill to stop the enforcement of federal Electronic Logging Device (ELD) requirements by state officers.
The bill was introduced on Wednesday, February 14th and is sponsored by seven Wyoming Senators, as well as 12 State Representatives.
In the Wyoming senate filing, the bill is described as
“AN ACT relating to commercial vehicles; specifying that federal rules requiring electronic logging devices are not required under Wyoming law; preventing Wyoming officers from enforcing specified federal requirements…”
The bill also states that, should it be passed, the state of Wyoming will adopt its own rules regarding “the permissible operating time and other requirements of motor carrier drivers and equipment standards that are comparable to rules established before the December 16, 2015,” and that no law enforcement officer in Wyoming will be able to “enforce any rule or regulation for permissible operating time and equipment standards except as provided in this subsection and department rules.”
The bill also cites the state’s authority to “adopt rules and regulations governing drivers, equipment and hazardous materials,” with the exception of maximum operating hours.
The law would become effective immediately upon the completion of “all acts necessary for a bill to become law.” As of Thursday, February 15th, there is no current estimate for when that may be.
