A box truck driver has been charged with second-degree manslaughter after rear-ending a motorist while shopping online on his cell phone.

He was charged on Thursday, August 17th and will be arraigned in the Lancaster, New York town court.

According to the Albany Times-Union, 27-year-old Kristofer M. Gregorek was driving west on the New York State Thruway between the 48a and 49 interchanges in Lancaster, New York when he crashed into the back of a sedan.

The sedan was driven by 45-year-old Ellen Volpe, who was killed in the accident. One other person involved in the accident was taken to a nearby hospital with non life-threatening injuries.

Gregorek was not injured in the accident.

State police investigated the crash and found Gregorek to be using his cell phone to shop online at the time of the accident.

Gregorek was then charged with second-degree manslaughter, a class C felony.

Gregorek’s arraignment date has not yet been determined.
