12 former drivers were payed nearly half a million dollars by Pam Transport as ordered by the Department of Labor after a court determined that the carrier violated the Americans with Disabilities Act.

The drivers were forced to undergo a medical policy which required them to inform the carrier of any meeting with a medical professional, even for simple physicals.

According to the DOL’s Equal Employment Opportunity Commission, that policy violated federal law so a law suit was filed against Pam Transport.

Back in 2012 PAM was forced to stop the abusive practice, and on Feb 26th 2015, the court ordered PAM to pay $477,000 in back pay and fines.

EEOC attorney Nedra Campbell commented on the case and said: “This order should encourage companies to think twice about subjecting its workforce to overly broad medical inquiries. Companies must ensure that their medical inquiry policies are job-related and consistent with business necessity, as required by federal law.”

PAM Transport is based out of Arkansas and operates in 48 states, as well as Mexico and Canada.
