A bicycle advocacy group is calling for the conviction of a trucker involved in a fatal wreck with a bicyclist, despite the District Attorney’s ruling declaring the driver not guilty.

Surveillance footage of the accident was released earlier this month, but the incident occurred in Boston, Massachusetts back in August of 2015.

According to Boston CBS Local, Dr. Anita Kurmann was riding her bike across the Mass. Ave. Bridge in the bike lane on the right side of the tractor trailer, driven by Matt Levari, when the semi truck began to pull ahead. The truck then turns right onto Beacon Street, but Kurmann keeps going straight, driving into the side of the truck, where she is run over.

In the investigation following the incident, the Suffolk County District Attorney decided that it “did not reveal driver impairment, distraction, excessive speed, failure to signal, or disregard of a known risk,” and that trucker Matt Levari was innocent.

Boston Magazine reported that, “police have determined that Kurmann was at fault, that she should not have been in the bus lane, and that she had plenty of time to realize the truck was turning.”

Now however, the members of organization ‘MassBike’ have seen the released surveillance footage, and say that their findings put Levari at fault.

“Sixteen seconds she’s there,” said Joel Feingold, a member of MassBike, as he described the footage of the incident.

“That’s lots of opportunity for the truck driver to say, ‘oh she’s caught up with me, I have to be careful….’ Upon reviewing the security camera footage, we were left incredulous… We were disappointed to learn that the crash investigation placed the blame entirely on Dr. Kurmann,” Feingold continued.

“There’s a real injustice here.”

Despite the organization’s claims of injustice, Boston Police say they stand by their investigation findings, and say that there is no evidence pointing to the guilt of the truck driver.
