
Many carriers are using sleep apnea as a reason to fire or not hire drivers nowadays, but is it legal? Apparently not.
According to the Americans with Disabilities Act, a person is considered disabled even with a CPAP machine or a similar assistive device.
As amended in 2008, the act doesn’t allow employers to fire you or not hire you if the condition is treated.
They must also provide reasonable accommodations in order to treat the disability. Reasonable accommodations means that they must allow you to install a CPAP machine in your truck.
Unfortunately, many drivers still live with the fear of not not being hired, if diagnosed.
