Former drivers of bankrupt New Jersey carrier, New Century Transportation, have filed a class-action lawsuit against the firm for not giving drivers adequate notice before they shut down.

According to court documents, 1500 New Century employees were terminated on June 9th when they filed for Chapter 7 bankruptcy protection.

Out of the 1500 employees, 1000 were truck drivers.

The driver leading the charge against the company, Robert Kearney, believes that the company was unlawful by not providing employees written notice before they were let go. Kearney references the federal Worker Adjustment and Restraining Notification Act which requires companies to give a 60 day notice to employees in the event of mass layoffs and plant closings.

He is seeking damages of 60 days worth of pay for the drivers involved in the class action suit. Many drivers are now scrambling to find employment due to the sudden shut down of the company.
