A truck driver from Indiana was able to breathe a sigh of relief today after receiving a deferred sentence instead of further jail time.

David Burt Welk of Indiana, was arrested after hitting 81-year-old Elgie Bedford. The 81 year old was walking on the westbound lane of Interstate-90 in Montana after leaving his vehicle.

Investigators believe that the elderly man was struck by multiple vehicles that morning, but only Welk was charged with a crime.

Prosecutors were arguing for a five year jail sentence, however Welk will instead get a six-year deferred sentence. If he successfully completes the six-year probation, the charges will be dismissed.

The Indiana truck driver had already served 348 days in jail while waiting for his trial.

His clean criminal record played a part in the judges decision.
